Mayor Jim Millirons called the regular meeting of the Morrow City Council to order at 7:30 p.m. The meeting took place in the Council Chambers of the Morrow Municipal Complex, 1500 Morrow Road, Morrow, GA, 30260. Everyone stood for the Pledge of Allegiance to the flag. Mayor Pro Tem Sorrow gave the invocation.
APPROVAL OF MINUTES: Work Session – October 9, 2007

Councilman Sorrow made a motion to approve the minutes, seconded by Councilman Huie. The motion passed unanimously.
PUBLIC HEARING:
The third Public Hearing for Ordinance 2007-11, to set the milage for the calendar year 2007, by establishing the gross milage for maintenance and operation at Ten (10) mils, less the rollback of Five (5) mils for Local Option Sales Tax, leaving a net milage for maintenance and operation purposes set at Five (5) mils.

PRESENTATION:
1. Mayor Millirons and Chief Baker presented a 10 year service pin to Rebecca Lovinski of Morrow Police Department.
2. Chief of Police, Jeff Baker, presented highlights from the International Association of Chiefs of Police Award Ceremony that he attended in New Orleans and accepted First Place in the Nation on Law Enforcement Challenge and The Georgia Office of Highway Safety Governors Cup for placing First in the State of Georgia on behalf of the City of Morrow Police Department.
OLD BUSINESS:
1. Ordinance 2007-11; Second reading of an ordinance to set the milage for calendar year 2007, by establishing the gross milage for maintenance and operation at Ten (10) mils, less the rollback of Five (5) mils for Local Option Sales Tax, leaving a net milage for maintenance and operation purposes set at Five (5) mils.
Councilman Sorrow made a motion to pass Ordinance 2007-11, seconded by Councilman Slaton. The motion passed unanimously.
NEW BUSINESS:
1. Resolution 2007-16; A Resolution granting Mayor Jim Millirons the authority to negotiate and execute, deliver and perform all documentation related to the Intergovernmental Agreement for the Use and Distribution of Proceeds From the 2008 Special Purpose Local Option Sales Tax (SPLOST) for Capital Outlay Projects, defined in the Clayton County, The City of Morrow, and other Clayton County Municipal projects Exhibits.
Councilman Sorrow made a motion to pass Resolution 2007-16, seconded by Councilman Slaton. The motion passed unanimously.
2. Resolution 2007-17; A Resolution authorizing Mayor Millirons to negotiate and execute all documents related to the Call for an Election to Impose a County Special Purpose Local Option Sales Tax.
Councilman Slaton made a motion to pass Resolution 2007-17, seconded by Councilman Barfield. The motion passed unanimously.
3. Resolution 2007-18; A Resolution accepting the conveyance of Loop Road from the Morrow Downtown Development Authority to the City of Morrow.
Councilman Sorrow made a motion to pass Resolution 2007-18, seconded by Councilman Huie. The motion passed unanimously.
4. Approval of an Intergovernmental Agreement for the Use and Distribution of Proceeds From the 2008 Special Purpose Local Option Sales Tax for Capital Outlay Projects, defined in the Clayton County, The City of Morrow, and other Clayton County Municipal project Exhibits, written by Clayton County and to be executed by Clayton County, The City of Forest Park, The City of Morrow, The City of Riverdale, The City of Lake City, The City of Lovejoy, The City of College Park and The City of Jonesboro.
Councilman Huie made a motion to approve the Intergovernmental Agreement, seconded by Councilman Barfield. The motion passed unanimously.
5. Joyce Bean presented a petition to annex certain properties on Argonne Drive, Childers Way, Debbie Sue Lane, Lake Harbin Road, Lynn Dale Lane, Peacock Boulevard, Pershing Way, Pinecrest Drive, Pine Valley Drive, Pleasant Valley Drive and Randall Mark Drive for Mayor and Council approval.
Mr. Mayor and Council Members:
The City of Morrow has received 82 requests for annexation into the City from the neighborhood that includes portions of Argonne Drive, Childers Way, Debbie Sue Lane, Lake Harbin Road, Lynn Dale Lane, Meadowbrook Lane, Peacock Boulevard, Pershing Way, Pine Valley Drive, Pinecrest Drive, Pleasant Valley Drive, and Randall Mark Drive.
The staff has checked the annexation petitions, verified ownership through deed and tax records, verified registered voters residing in the area and determined a geographical area that encompasses all the petition signers and meets all applicable requirements of the 60% annexation method. The area encompasses a total of 59.78 acres. A survey has been completed and a legal description prepared. Our City Attorney has reviewed the petitions, survey, legal description and associated documents and is satisfied the area comports with all legal requirements for annexation under the 60% method.
A complete listing of all petitions is attached to the survey and legal description of the area considered for annexation. The first step in the process is for the City Council to make a determination that the area identified for annexation complies with all legal requirements of the Code. Once that is done, the County and all petitioners will be notified. A public hearing held and an annexation ordinance adopted after two readings. We are requesting November 27, 2007 as the date for public hearing and first reading. The Plan for Extension of Services will be prepared and available for review no later than November 13, 2007.
Mayor Millirons’ response:
Having reviewed the annexation petition package, the legal description and survey of property proposed to be annexed, and having received staff’s report and the opinion of the City Attorney that the package meets all
standards for annexation under the 60% method, I find that the annexation meets legal standards and move that the annexation process go forward, that notice be provided immediately to the County, that the Plan for Delivery of Services be completed no later than November 13, 2007 and that public hearing to be scheduled for November 27, 2007 at 7:00 p.m., Morrow City Hall.
Councilman Sorrow made a motion to approve the petition to annex, seconded by Councilman Slaton. The motion passed unanimously.
